This is an application under Order 41 Rule 19 read with Section 151 CPC for restoration of the cross objection which was dismissed for nonprosecution vide order dated 04.10.2024. 2.

For the reasons stated in the application which is supported by an affidavit, the application is allowed and the order dated 04.10.2024 is recalled and the cross-objection is ordered to be restored to its original number.

A perusal of the paper book would show that the claimant is not appearing in the matter and has even not sought for restoration of the appeal.

Learned counsel for the cross-objector, in view of the same, has submitted that the cross-objection be disposed of but liberty be granted to revive the cross-objection in case the claimant revives the main appeal. 3.

In view of the above, the present cross-objection is disposed of with the aforesaid liberty.
