(ORAL) Petition herein is, inter alia, for issuance of a writ in the nature of Mandamus for directing respondent No.3 i.e., Election Tribunal/ trial Court to conclude trial of the case bearing No.EP-9-2022 titled "Smt. Bhagesh versus Jeenat and another", expeditiously, within time bound manner. 2.
Learned counsel for the petitioner submits that petitioner challenged the general election, for the post of Sarpanch of Gram Panchayat, Didhara, Tehsil Tauru, District Nuh, held on 02.11.2022, by way of an election petition bearing No.EP-9-2022 titled "Smt. Bhagesh versus Jeenat and another" before learned Additional Civil Judge (Senior Division), Nuh. He submits that the aforesaid election petition is pending adjudication and by way of present writ petition, he, inter alia, seeks a direction to respondent No.3/Election Tribunal to conclude the trial in the aforesaid case, expeditiously, within a time bound manner. On the other hand, on advance service of copy of petition, learned State counsel appears and opposes issuance of notice of motion, and expresses his no objection, in case, petitioner is granted the aforesaid relief. 4.
Without commenting on the merits of the case and considering the relief sought for herein, the writ petition is disposed of with a direction to respondent No.3 Election Tribunal to take all necessary steps and dispose of the aforesaid election petition pending before it, at the earliest. 5.
