CWP-14940-2019 (O & M) Date of decision: 29.05.2019 Parkash Chand .... Petitioner(s) V/s State of Punjab and ors.

...Respondent(s)

CORAM:

HON'BLE MR. JUSTICE RAJAN GUPTA

Present:

Mr. Dinesh Kumar, Advocate, for the petitioner. ***** Rajan Gupta, J. (Oral) Petitioner has prayed for a writ in the nature of certiorari for quashing order dated 04.10.2007, Annexure P-17, whereby his plea for regularization from retrospective date has been rejected. A perusal of the impugned order shows that the matter was duly considered by the concerned authority. Petitioner sought comparison with another employee namely Gurmeet Singh, who has been working as Mason w.e.f. Ist December, 1994. The authority, however, found that the petitioner had been working on daily wages. His plea to seek parity with Gurmeet Singh could not accepted as said employee was engaged on 01.08.1983 and had completed 10 years of service of daily wages on 30.11.1994, which is a pre-condition to be considered under policy. He was, thus, regularized w.e.f. 01.

12.1994. Case of the petitioner is distinguishable as he had not completed ten years of service as on 30.11.1994 being engaged in the year 1992. Admittedly, petitioner has been regularized w.e.f. 23.01.2001. This court finds no infirmity with the order. It also finds no merit in the plea that the petitioner needs to be considered in terms of Instructions dated 18/20.01.1995 issued by Government of Punjab. Petition is without any merit and is hereby dismissed. (RAJAN GUPTA) May 29, 2019 JUDGE sukhpreet Whether speaking/reasoned : Yes/No Whether reportable : Yes/No SUKHPREET KAUR 2019.06.
