Main case Instant petition has been filed under Section 482 Cr.PC for quashing of the order dated 09.02.2023 vide which the bail bonds and surety bonds of the petitioner have been forfeited in case FIR No.257 dated 21.09.2014 under Sections 120-B, 148, 149, 201, 307, 323, 326, 427, 452 IPC and Section 25 of Arms Act registered at Police Station Chandimandir District Panchkula. Learned counsel for the petitioner submits that the petitioner was on bail in the FIR in question and had been regularly appearing before the trial Court, however, on 09.02.2023 he could not appear before the Court concerned due to the ill-health of his father-in-law, who was admitted at PGI, Chandigarh. Notice of motion.

On the asking of Court, Mr. Chetan Sharma, AAG, Haryana accepts notice on behalf of the respondent-State. In view of the submissions made above, the petition is disposed of with directions to the petitioner to appear and surrender before the trial Court on or before 05.04.2023 and move appropriate application for grant of bail. Till then no coercive steps be taken against the petitioner. The trial Court on such application being moved shall decide it expeditiously in accordance with law. It is, however, made clear that in case the petitioner fails to appear and surrender before the Court below within the above stipulated time period, then this order shall be of no avail to him.
