The petitioners seek quashing of FIR on the basis of compromise in a case of assault of the year 2010. On asking of the court, it has been informed that the entire prosecution evidence has been recorded and the case is at the stage of recording of statement of the accused u/s 313 Cr.P.C. The next date of hearing before the trial court is 1.8.2016.

Since the parties have compromised the matter six years after the occurrence, the petition is disposed of with a direction that the trial court shall record the statements of the parties regarding matter having been compromised and arrive at a conclusion that the compromise has been arrived at without any threat coercion or undue influence and that none of the effected party is aggrieved by any action of the accused and that none of the accused persons is a proclaimed offender. On the basis of the statements of parties, it will be open to the trial court to permit the compounding or to grant the benefit of doubt or any other relief, in accordance with law.
