Sushil Lamba v. State Of Haryana And ORS.
In the High Court of Punjab and Haryana, at Chandigarh Criminal Misc. No. M-13166 of 2019 Date of Decision: 20.03.2019 Sushil Lamba ... Petitioner(s)
Versus
State of Haryana and Others ... Respondent(s) CORAM: Hon'ble Mr. Justice Shekher Dhawan.
Present:
Mr. Ganesh Chand Sharma, Advocate for the petitioner(s).
Shekher Dhawan, J.
Present petition under Section 482 Cr.P.C. for seeking directions to register an FIR against respondent No.7.
Learned counsel for the petitioner fairly conceded that by now petitioner has not approached the concerned Court of learned Area Judicial Magistrate and make request to exercise powers under Section 156(3) Cr.P.C.
As per view taken by the Hon'ble Apex Court in Sakiri Vasu v. State of U.P. & Others 2008(1) RCR (Criminal) 392, no ground is made out in the present petition, while exercising the powers under Section 482 Cr.P.C. However, petitioner shall be at liberty to move an application before the learned Area Judicial Magistrate for redressal of his grievance. As such, present petition stands disposed of.
