This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No. 116 dated 09.09.2013 under Sections 376/506/120-B IPC at Police Station Mukerian.

Learned counsel for the petitioner submits that petitioner is in custody since 06.05.2015. According to him, petitioner is married to the complainant. Due to some misunderstanding, instant FIR was lodged. Thus, no useful purpose would be served by detaining the petitioner in custody any longer. Learned State counsel has opposed the prayer on the ground that allegations against the petitioner are serious. I have heard learned counsel for the parties. Keeping in view the aforesaid contentions and period of incarceration of the petitioner, I am of the considered view that no useful purpose would be served by detaining the petitioner in custody any longer. CRM M-24473 of 2015 of the case, I deem it appropriate to grant regular bail to the petitioner. Accordingly, the petition is allowed and petitioner is ordered to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Hoshiarpur.
