This is the petitioner's fourth attempt to get bail during the pendency of the trial in a criminal case arising from FIR No. 251 dated 12.12.2019, registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Sangat, District Bathinda, Punjab.

As per the case of the prosecution, the petitioner along with the co-accused, namely Vansh alias Bobby was found in conscious possession of 300 tablets of Clovidol 100 SR.

The first and second petitions for grant of bail were dismissed on merits on 24.07.2020 and 18.01.2021, whereas, the third petition for grant of bail was dismissed for non prosecution on 29.10.2021. The petitioner is admittedly in custody for a period of more than three years. It has been stated that as of now, out of 12 prosecution witnesses proposed to be examined, only the statements of four witnesses have been recorded.

The learned counsel representing the petitioner submits that the petitioner's father suffers from numerous disabilities as both his legs are amputated due to gangrene. The conclusion of the trial is likely to take some time. The petitioner has already suffered incarceration for a period of more than three years.

Keeping in view the peculiar facts of the case, it is considered appropriate to enlarge the petitioner on bail. Hence, the present petition is allowed. The petitioner is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of the trial Court/Chief Judicial Magistrate/Duty Magistrate, concerned.
