CRM-M-25442-2016 Present petition has been filed under Section 438 Cr.P.C. seeking grant of anticipatory bail to the petitioner in case registered by way of FIR No.90 dated 04.07.2016 at Police Station Saha District Ambala under Sections 66, 72, 72-A of Information Technology Act and Sections 379, 420 IPC.
Learned counsel for the petitioner submits that in compliance of orders of interim bail dated 28.07.2016 passed by this Court, the petitioner has joined investigations which is not controverted by learned State counsel on instructions from ASI Ramesh Kumar Police Station Saha, SUNIL DEVI 2017.01.09 11:35 I attest to the accuracy and integrity of this document
CRM-M-25442-2016 -2District Ambala who submits that the petitioner is no longer required for further investigation and nothing is to be recovered from him and that he has no objection if the interim order is made absolute. Though the same is sought to be opposed by learned counsel for the complainant. However, keeping in view the stand of the Investigating Officer and the stand of the State, the interim bail granted to the petitioner vide order dated 28.07.2016 is made absolute on the same terms and conditions till submission of report under Section 173 Cr.P.C.(challan). Thereafter, petitioner will be permitted to furnish regular bail bonds to the satisfaction of the trial Court.
