The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, seeking quashing of NACT Complaint No.184 of 2023 dated 09.05.2023 (Annexure P-3) titled as "Jai Pal Vs. Amrish Kumar" filed under Section 138 of Negotiable Instruments Act, 1881 pending in Court of learned Sub Divisional Judicial Magistrate, Naraingarh as well as summoning order dated 09.05.2023 (Annexure P-4) vide which, the petitioner has been summoned to face trial for an offence under Section 138 of Negotiable Instruments Act, 1881 and all consequential proceedings arising therefrom. 2.

After arguing for sometime, learned counsel for the petitioner seeks to withdraw the present petition with liberty to raise all the pleas before an appropriate Court, at an appropriate stage.

In view of above, the prayer so made is allowed. 4.

Dismissed as withdrawn, with liberty aforesaid. 5.
