The extraordinary jurisdiction, vested in this court by virtue of Section 528 of 'the Bharatiya Nagarik Suraksha Sanhita, 2023', hereinafter being referred to as "BNSS" only, has been invoked by virtue of present petition. A prayer for quashing of orders dated 08.01.2026 and 06.02.2026 passed by the court of learned Judicial Magistrate 1st Class, Faridabad, has been made by the petitioner.

At the very outset it has been contended by learned counsel for the petitioner that the order dated 06.02.2026 may be set aside with regard to closure of opportunity to the petitioner to lead defence evidence. The learned counsel for the petitioner has prayed for granting only two opportunities to lead defence evidence.

The learned counsel for the complainant has gracefully conceded to the claim of petitioner that he has got a right to defend himself. 6.
In view of above-mentioned agreement, the impugned order dated 06.02.2026 is hereby set aside and the petitioner is hereby afforded two effective opportunities to lead defence evidence. The present petition stands disposed of, accordingly.
