On 29.06.2020, the following order has been passed by this Court:- "On account of outbreak of covid-19 the instant matter is being taken up through video conferencing. Instant petition has been filed under Section 438 Cr.P.C for grant of anticipatory bail to the petitioner in FIR No. 56 dated 13.4.2020 for the offences under Sections 61 of the Excise Act registered at Police Station Nehianwala, District Bathinda. Learned counsel for the petitioner inter alia contends that the petitioner has been falsely implicated in the instant case being the son of the co-accused from whom 20 bottles of illicit liquor and two drum of 75 kgs each Lahan have been recovered. Criminal Misc. No. M- 13001 of 2020 It has further been submitted that neither was he arrested at the spot nor any recovery effected from him.

Learned counsel for the State on instructions from ASI Sukhpal Singh submits that the petitioner is not involved in any other criminal case, much less cases of similar nature. The petitioner is directed to join the investigation as and when called upon by the investigating agency/Investigating Officer. On his appearance, he shall be released on interim bail to the satisfaction of arresting/investigating officer. The petitioner shall abide by the conditions specified under Section 438 (2) Cr.P.C.

Adjourned to 30.9.2020".

Ms. Samina Dhir, Deputy Advocate General, Punjab, on the instructions from Assistant Sub Inspector Sukhpal Singh, has submitted that the petitioner has joined investigation, co-operated and not required for further custodial interrogation.

In view of the aforesaid facts, the present petition is allowed and interim pre-arrest bail granted to the petitioner by this Court on 29.06.2020 is made absolute.
