RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to the petitioner in case FIR No.49 dated 04.04.2017 under Section 22 of the NDPS Act registered at Police Station City Hoshiarpur, District Hoshiarpur.

Learned counsel for the petitioner contended that the petitioner is in custody since 04.04.2017. It is yet to be determined whether the drug allegedly recovered from the petitioner is a narcotic substance. Learned counsel for the petitioner relies upon the judgment of this Court in Inderjeet Singh @ Laddi and others v. State of Punjab, 2014(3) R.C.R.(Criminal) 953.

Learned counsel for the State, on instructions from ASI Jasbir Singh, stated that FSL report has not yet been received. In view of above, petitioner is admitted to interim bail subject to furnishing his bail bonds and surety bonds to the satisfaction of the trial Court.

Disposed of.
