Present petition under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No. 41 dated 8.5.2017, registered under Section(s) 21 of the Narcotic Drugs & Psychotropic Substances Act, 1985, at Police Station Jhansa, District Kurukshetra. Learned counsel for the petitioner contended that petitioner is in custody for a period over two months; he is not involved in any other case and decision of the case still to take some more time. Thus, petitioner be released on regular bail.
Learned counsel for the respondent-State, on the basis of custody certificate, affirmed the period of sentence already undergone by the petitioner as undertrial and opposed the petition that there is no ground for releasing him on regular bail.

Criminal Misc. No. M-24604 of 2017 Having considered the submissions made by learned counsel for the parties; the fact that the petitioner is in custody for a period over two months; trial of the case still to take some more time and no useful purpose shall be served by detaining him in custody any further, the present petition is accepted. The petitioner is ordered to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Kurukshetra.
