The prayer in the present Civil Writ Petition filed under Article 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus directing the respondents to grant the family pension to the petitioner. 2.

Learned counsel would contend that mother of the petitioner who was working as Sweeper in the Government School, retired on attaining the age of superannuation, on 30.06.2021, unfortunately passed away on 03.01.2022. Though the PPO number was issued, however, the family pension has not yet been released to the petitioner. The petitioner obtained the succession certificate which has also been submitted to the respondent department. He is 60% permanently disabled and solely dependent upon the family pension. Learned counsel submits that the petitioner would file a representation within 4 weeks, which may be directed to be decided in a time bound manner by granting him an opportunity of hearing.

In view of the aforesaid and without commenting upon the merits of the case, this petition is hereby disposed of with a direction that in case the petitioner submits a representation within a period of 4 weeks, the same shall be decided expeditiously, preferably within 3 months, by the respondents and if found entitled, necessary benefit be granted to him forthwith.
