Instant petition has been filed under Section 438 of the Code of Criminal Procedure seeking anticipatory bail to the petitioner in case FIR No.53 dated 09.03.2020 registered under Sections 307, 148, 149 of Indian Penal Code and Sections 25, 27 of Arms Act, at Police Station Division No.7, Ludhiana (Annexure P-1).

There has been no representation on behalf of the petitioner on the last three dates. On 01.09.2021, this Court passed the following order:- "Heard through video conferencing.

There is no representation on behalf of the petitioner. List on 17.09.2021.

As per office report, information was given to the counsel representing the petitioner, Mr. Gaurav Rana, on his mobile number 9915589838 through voice call on 13.09.2021 at 11:35 a.m and through text message on that same very number. However, there was no representation on behalf of the petitioner even on 17.09.2021 when the following order was passed:- "Heard through video conferencing.

Though request for taking up the matter in virtual mode has been received in Whatsapp group, yet there is no representation on behalf of the petitioner even during the second round. The petitioner remained un-represented even on the previous two dates of hearing.

In the interest of justice, adjourned to 28.09.2021." Again there is no representation on behalf of the petitioner. In these circumstances, the Court is constrained to dismiss the petition in default of appearance.

Ordered accordingly.
