Petitioner has filed this petition under Section 438 of the Code of Criminal Procedure, 1973 seeking anticipatory bail in FIR No. 77 dated 1.7.2015 under Section 306, 34 of the Indian Penal Code, 1860, registered at Police Station G.R.P. Bathinda, District Bathinda.
While issuing notice of motion, following order was passed by this Court on 29.7.2015:- "Heard.
Learned counsel for the petitioner submits that Balwinder Singh son of complainant died on railway track on the night intervening 22/23.10.2014. After seven months of the incident, a complaint was made upon which FIR No.77 dated 01.07.2015 was registered at Police Station GRP Bathinda on the allegation that GURPREET SINGH 2015.10.08 15:55 I attest to the accuracy and authenticity of this document chandigarh
Crl. Misc. No. M-24584 of 2015 -2Balwinder Singh committed suicide on being abetted to do so by his wife and her lover i.e. present petitioner. Notice of motion for 08.10.2015.
In the meanwhile, the petitioner is directed to surrender before the police and join investigation within a week. In the event of his arrest being required, he shall be released on interim bail, till the next date, subject to his furnishing bonds to the satisfaction of Arresting Officer. However, he shall abide by the terms and conditions as envisaged under Section 438(2)(i) to (iv) Cr.P.C. failing which he shall loose the benefit of interim bail allowed to him."
Learned State counsel, who is assisted by Assistant Sub Inspector Jaswinder Singh, has submitted that in terms of the above order, petitioner has joined investigation and is not required for further investigation.
Accordingly, interim bail granted by this Court to the petitioner vide order dated 29.7.2015, is made absolute. Petition stands disposed of accordingly.
