(Oral) On the last date of hearing while noticing the factual position, a detailed order was passed, the operative portion of which reads as follows :- "Having heard the learned counsel for the petitioner and also the State counsel it is ordered that the statements of the aforesaid 3 witnesses namely HC Sandeep, SI Satish Kumar and Inspector Deepchand be not recorded in the departmental proceeding until the said witnesses have been duly examined in the criminal trial pending against the petitioner."

The learned State counsel has submitted that he has instructions to the effect that in the departmental proceedings, the aforesaid three witnesses namely HC Sandeep, SI Satish Kumar and Inspector Deepchand would not be examined till they are examined in the criminal trial pending against the petitioner.

CWP No.7447 of 2020 (O&M) In view of the aforesaid assurance, the learned counsel for the petitioner submits that he does not press upon this petition at this stage and may be permitted to withdraw this petition.

In view of the aforestated position, the petition is dismissed as withdrawn with liberty to the petitioner to file afresh, in case need be, subject to the condition that the petitioner complies with the directions which have been issued on 15.6.2020 regarding his cooperation with the proceedings of the trial and not to resort to dilatory tactics. The petition stands disposed of as withdrawn with the aforesaid directions.
