CORAM:

HON'BLE MR. JUSTICE MANOJ BAJAJ

Present:

Mr. Ajay Kumar Sharma, Advocate for the petitioner.

Mr. Hittan Nehra, Addl. A.G., Punjab.

*** MANOJ BAJAJ, J.

This petition has been filed by the petitioner under Section 438 Code of Criminal Procedure for grant of anticipatory bail in case FIR No.255 dated 17.10.2018 under Sections 419, 420 and 386 IPC, registered at Police Station Sohana, Tehsil & District Mohali. The petitioner apprehended his arrest at the hands of Police. The FIR was registered on the basis of the complaint given by Rajeev Arora against Ranjit Singh and Sukhpal Singh (petitioner), wherein it was alleged that Ranjit Singh while posing as SHO, Mohali contacted his neighbour for conveying a false complaint regarding pendency of a complaint before SSP, Mohali. Complainant on 13.09.2018 received the message from his neighbour and went to the SSP Office, Mohali where Ranjit Singh asked him to wait outside. Later on the said accused demanded `20 lacs for settlement of the case, in the name of DGP. It was narrated that Sheetal Gawri 2019.07.25 17:52 I attest to the accuracy and integrity of this document Chandigarh the complainant was called at a particular place at around 5:30 PM, where

CRM-M-13455-2019(O & M) -2the complainant was beaten and Sukhpal Singh (petitioner) snatched `4,000-5,000/- from his pocket. The threats were also extended to the accused.

Learned counsel contends that before the present incident, a complaint (Annexure P-1) was given by Surinder Kaur and Sukhpal Singh against the complainant namely Rajiv Arora. A perusal of the said complaint does not make out meaningful grievance of the petitioner. Even learned counsel for the petitioner is unable to define the grievance contained in the said complaint.

Considering the allegations levelled by the complainant, which are serious in nature, this Court finds that no case is made out for grant of anticipatory bail to the petitioner.

Dismissed.
