NIDHI GUPTA, J. (ORAL) Prayer in this 1st petition filed under Section 439 Cr.P.C., is for grant of regular bail to the petitioner in case FIR No.822 dated 23.09.2023 registered under Sections 328, 376(2)(n) and 506 read with Section 34 IPC and Sections 6 and 17 of the Protection of Children from Sexual Offences Act, 2012 at Police Station City, District Hisar. Learned counsel for the State has filed custody certificate dated 01.04.2024, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 05 months and 06 days.

After arguing for some time, when this Court is not inclined to accord the benefit of regular bail to the petitioner, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage.

Permitted to do so.

Dismissed as withdrawn, at this stage.
