-.- JAISHREE THAKUR J. (ORAL) On receipt of application received through e-mail from Sukhwinder Singh son of Tara Singh resident of Street No.4, Nanak Nagri, Abohar, the same has been entertained as writ of habeas corpus under Article 226 of the Constitution of India.

Notice of the said petition was issued to the State of Punjab pursuant to which appearance has been caused by the State of Punjab. Mr. Dhuriwala, Sr. DAG, Punjab appearing for the respondentState submits that the matter has been rendered infructuous, as the alleged detenue Kirandeep Kaur is now in the custody of her father i.e. the complainant-Sukhwinder Singh. In fact, statements of both Sukhwinder Singh and Kirandeep Kaur have been recorded. The alleged detenue Kirandeep Kaur stated that she got married with Aman Kumar son of Mahesh Kumar without consent of her parents and after marriage she had been residing in her matrimonial home. It was on account of ill-treatment meeted to her, she called her father Sukhwinder Singh, who had taken her back to her parental home on 24.05.2020 and since then she is residing with her parents. The statement of Sukhwinder Singh has also been recorded to the effect that he has brought back his daughter from her matrimonial home PANKAJ KUMAR 2020.06.12 14:36 I attest to the accuracy and integrity of this document

I have heard learned counsel for the respondent-State and have perused the reply filed by way of affidavit of Sh. Rahul Bhardwaj, PPS, Deputy Superintendent of Police, Sub -Division Abohar, District Fazilka as supplied through Whatsapp. In view of the fact that the alleged detenue is residing with her father, no further orders are called for in the instant petition. However, the respondent-State is directed to place reply filed by way of affidavit of Sh. Rahul Bhardwaj on the file of instant petition. Disposed of accordingly.
