(Oral) Prayer in the present petition filed under Section 438 of the Code of Criminal Procedure, 1973 is for grant of anticipatory bail to the petitioner in case FIR No.62 dated 12.06.2017 under Sections 406, 498-A IPC registered at Women Police Station, Sector 17, Chandigarh. Vide order dated 30.07,2018, the matter was referred to the Mediation and Conciliation Centre of this Court and thereafter, on 14.01.2020, this Court has passed the following order:- "In the pre-lunch session, the matter was passed over and is taken up in the post-lunch session.
At this stage, learned counsel for the petitioner, on instructions from the petitioner, who is present in Court, states that the petitioner is ready to settle the dispute with respondent No.2-wife and is ready to offer a sum of Rs.15 lakh ASHWANI KUMAR 2020.02.18 10:02 I attest to the accuracy and integrity of this document
Criminal Misc. No. M-24699 of 2017 -2to be paid to respondent-wife and son towards final settlement which shall include present, past and future maintenance of respondent No.2 and the child. He further states that the petitioner requires some time to arrange for this huge amount, however, he undertakes to make this payment within six months from today or on the date when the statements of the petitioner and respondent No.2 would be recorded at second motion stage in the petition under Section 13-B of the Hindu Marriage Act, 1955 (for short, the Act), whichever is later. The petitioner will file a joint petition under Section 13-B of the Act within one month from today, provided respondent No.2 cooperate with him in drafting and filing the said petition.
Learned counsel for respondent No.2, on instructions from his client, who is present in Court, has accepted the aforesaid offer made by the petitioner.
Accordingly, the petitioner and respondent No.2 are again relegated to the mediation so as to formulate the settlement/agreement and they shall appear before the Mediator on 17.01.2020.
Report is awaited for 17.02.2020."
Accordingly, report dated 17.01.2020 to the effect that a settlement/agreement has arrived between the parties on 17.01.2020 has been received from the mediator.
