This order will dispose of above mentioned two petitions filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No.92 dated 8.6.2018 registered for the offence under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as `the Act') at Police Station Canal Colony, District Bathinda. [2] Notice of motion was issued in these cases.
Ms. Monika Jalota, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested these petitions.
I have heard learned counsel for the petitioners as well as learned State counsel and have gone through the record. As per prosecution version, three persons, namely, Rakesh Kumar, Amandeep Singh and one co-accused, were found sitting on the left side of the canal. From them 24 vials of make Onerex each containing 100 ml. and 24 strips of tablets each containing 10 tablets total 340 tablets make Carisoma were recovered. Codeine was found in the vials of Onerex. The recovery falls in commercial quantity. Therefore, bar of Section 37 of the NDPS Act will apply in these cases and the petitioners are not entitled to the benefit of bail.
In view of the above discussion, I do not find any merit in these petitions and the same are dismissed.
