CORAM:HON'BLE MR. JUSTICE AMIT RAWAL -.- AMIT RAWAL J.(ORAL) In pursuance of the notice of motion order, Mr. Nikhil Kumar Chopra, Addl. A.G., Punjab has put in appearance and on instructions from ASI Manpreet Singh submits that the matter is still under investigation.

Mr. Amit Arora, learned counsel appearing on behalf of the petitioner submitted that it is a case of version and cross-version, for, as per MLR of the petitioner (Annexure P-1), he has also been inflicted injuries. The dispute allegedly is with regard to possession of Gurdwara Sahib but the police has not registered FIR on the complaint of the petitioner as the complainant's side is more influential.

As per the averments made by Mr. Nikhil Kumar Chopra that the matter is at the stage of investigation, I am of the view that custodial interrogation of the petitioner is not necessary and the petitioner will render full assistance to the police for recovery of the weapon used in alleged offence. CRM-M No.25697 of 2018 -2of by granting anticipatory bail to the petitioner on the condition that he shall join the investigation as and when required and in the event of his arrest, he shall be released on bail by the Investigation Officer on furnishing bail bonds/sureties to his satisfaction, subject to the conditions mentioned under Section 438(2) Cr.P.C. It is also made clear that in case the petitioner does not join investigation as and when called by the Investigation Officer by way of written notice, liberty is granted to the respondent-State to move appropriate application for modification/cancellation of bail.
