(Oral) This petition under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in case FIR No.22 dated 04.03.2020, under Section 406/498-A IPC (Section 377 IPC added lateron), registered at Police Station, Phase 8, Mohali (S.A.S Nagar). Learned counsel for the petitioner submits that the petitioner had deposited Rs.30,000/- towards litigation expenses in the Registry of this Court and the matter stands compromised between the parties. As per report of the Mediation Centre, the matter stands compromised between the parties and it has been duly signed by both the parties. The matter has been settled and the petitioner is ready to give Rs.6,3,000/- towards full and final settlement. Now the complainant has no objection if the bail is granted to the petitioner. CRM No. M-12858 of 2020 -2entered between the parties without any pressure. Both the parties shall be bound with the terms and conditions of the compromise dated 15.09.2020. Learned counsel for respondent No. 2 has admitted the factum of compromise affected between the parties and states that respondent No. 2 has no objection if bail be granted to the petitioner. In view of the compromise affected between the parties on 15.09.2020, the order dated 28.05.2020 is hereby made absolute. However, the parties are bound by the terms and conditions of the compromise dated 15.09.2020.
Registry of this Court is directed to release Rs.30,000/- deposited by the petitioner towards litigation expenses. Further if the petitioner does not comply with the terms and conditions of the compromise dated 15.09.2020, then the complainant is at liberty to revive this petition.
The petition stands disposed of.
