NIDHI GUPTA J. (Oral) Prayer in this petition is for issuing direction to the learned trial Court to conclude the trial in case FIR No.211 dated 16.10.2016 (Annexure P-1) under Sections 406 and 498-A IPC, registered at Police Station Phillaur, District Jalandhar. Learned counsel for the petitioner submits that the FIR in the present case was registered in the year 2016 and the case is still at the stage of recording of prosecution evidence. It is submitted that the challan in the present case was presented on 17.10.2017; and charges were framed on 03.11.2017. He submits that the prosecution evidence commenced thereafter, however, out of total 21 prosecution witnesses, only five witnesses have been examined so far. Learned counsel for the petitioner very fairly submits that during this time an application under Section 319 Cr.P.C. was also filed on behalf of VIJAY ASIJA 2024.03.22 16.40 I attest to the accuracy and integrity of this document
2024:PHHC:040922 CRM-M-14575-2024 complainant, however, the same was dismissed as far back in the year 2020; and even if two years in the interregnum are excluded due to Covid-19, even then the case is still at the stage of prosecution witnesses and only five witnesses out of twenty one have been examined so far.
Learned counsel for the petitioner submits that the petitioner was married to the respondent No.4 on 02.6.2011 and no child was born out of the said wedlock. The parties lived together for hardly one year. It is stated that great harassment is being caused to the petitioner due to pendency of the present trial. The abovesaid facts regarding pendency of the trial are not being disputed by learned counsel for the State. In view of the above, the trial Court concerned shall conclude the trial in question within a period of next six months from the date of receipt of certified copy of this order. The petition stands disposed of.
