**** RAJ MOHAN SINGH, J. (Oral) Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C in case bearing FIR No.0031 dated 01.03.2021 registered under Sections 61, 1, 14 of the Excise Act at Police Station Lopoke, District Amritsar.
Notice of motion was issued on 22.04.2021 on the premise that co-accused Simranjeet Kaur was arrested from the spot and recoveries were effected form her. Raid was conducted at her house. Petitioner is not the resident of that house, where raid was conducted. The factum of separate house has been verified by the Investigating Officer from Gram Panchayat, who had already passed a resolution to this effect. CRM-M No.16799 of 2021(O&M) Learned counsel for the petitioner submits that in compliance of the order dated 22.04.2021, petitioner has joined the investigation to the entire satisfaction of the Investigating Officer.
Learned State counsel on instructions from Investigating Officer submits that the petitioner has joined the investigation on 28.07.2021 and he is no more required for further investigation in the case.
In view of aforesaid factual position, the interim order dated 22.04.2021 is made absolute. Petitioner shall keep on joining the investigation as and when required to do so and he shall abide by the conditions as envisaged under Section 438(2) Cr.P.C.
Petition stands disposed of.
