Instant petition has been filed under Section 482 r/w Section 401 Cr.PC for setting aside the order dated 13.03.2023 (Annexure P-5) passed by Addl. Sessions Judge, Chandigarh vide which an order dated 14.12.2022 (Annexure P-2) in CRA-350-2022 suspending the sentence during the pendency of appeal was vacated.

Learned counsel for the petitioner, at the outset, prays that the petitioner be granted one more week to deposit 20% of the compensation amount in compliance of with the directions of the learned Sessions Court vide order dated 14.12.2022 (Annexure P-2). The petitioner has submitted that when the petitioner challenged the said order dated 14.12.2023 (Annexure P-2) before this Court in CRM-M-6662-2023, he was granted an additional 30 days to deposit the compensation amount vide order dated 08.02.2023 (Annexure P-3). Thereafter the petitioner had preferred a SLP before the Hon'ble Supreme Court wherein vide order dated 04.05.2023, the petitioner had been granted period of SONIA BURA 2023.05.17 12:14 I attest to the accuracy and integrity of this document

Learned counsel submits that the petitioner would deposit 20% of the compensation amount within a week from today as he has been able to arrange the said amount now and hence, a compassionate view be taken. 3.

Heard learned counsel for the applicant.

The present petition is disposed of with directions to the petitioner to deposit 20% of the compensation amount on or before 22.05.2023 before the learned Sessions Court, Chandigarh. However, it is made clear that in case the petitioner fails to comply with the aforesaid directions, this order shall be of no avail to him after 22.05.2023.
