(ORAL) The instant petition, preferred under Article 227 of the Constitution of India, assails the order dated 20.01.2023 passed by the Court of District Judge Fatehabad (executing Court) vide which objections to the execution petition filed by the respondent-decree holder (Haryana Sate Agriculture Marketing Board), seeking execution of award passed by the Arbitrator, were dismissed.

At the outset, learned counsel for the respondent, on the basis of instructions received vide communication dated 21.05.2026 from the Executive Engineer, Haryana State Agriculture Marketing Board Fatehabad, (a copy of which has been retained on the file) submits that the Board has no objection if the impugned order is set aside since the respondent would initiate proceedings for recovery of the amount due by availing other remedies as shall be admissible in law.

In view of the statement, the present revision petition is allowed. The impugned order is set aside and the objections are allowed. The execution petition is dismissed. The respondent shall be at liberty to avail other remedies as shall be admissible in law for recovery of the amount due to be paid to them under the award.
