(Oral) This is the 1st petition filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in FIR No.0279 dated 18.06.2020 registered under Sections 302, 323, 506, 148, 149 and 120-B of the Indian Penal Code, 1860 and Section 25 of the Arms Act, 1959 at Police Station City, Mahendergarh, District Mahendergarh. Learned State counsel as well as learned counsel for the complainant have pointed out in the present case that even the material witnesses, namely, Bijender, Sube Singh, Hoshiyar and Krishan have GEETA RANI 2022.09.02 15:31 I attest to the accuracy and authenticity of this document

In view of the above-stated position, learned counsel for the petitioner seeks to withdraw the present petition with liberty to file a fresh petition for regular bail before the trial Court after the said witnesses are examined.

Dismissed as withdrawn with liberty aforesaid. In case, the regular bail application is filed before the trial Court, the trial Court shall independently consider the same on its merits, in accordance with law.
