Jony v. State Of Haryana
In the High Court of Punjab and Haryana, at Chandigarh Criminal Misc. No. M-13674 of 2019 Date of Decision: 26.03.2019 Jony ... Petitioner(s)
Versus
State of Haryana ... Respondent(s) CORAM: Hon'ble Mr. Justice Shekher Dhawan.
Present:
Mr. Sunil Saharan, Advocate for the petitioner(s).
Shekher Dhawan, J.
Present petition under Section 482 Cr.P.C. for quashing of impugned order dated 22.02.2019, whereby the learned Sessions Judge, Hisar dismissed the application, filed by the petitioner, seeking exemption from his personal appearance.
Having considered the submissions made by learned counsel for the petitioner, this Court is not satisfied with the grounds taken in the present petition. As such, there is no ground to set aside the impugned order dated 22.02.2019 because two witnesses were in attendance and the accused cannot seek exemption from his personal appearance simply by moving an application without any justified reason in a criminal proceedings. Thus, present petition stands dismissed being devoid of any merit therein. (Shekher Dhawan) Judge March 26, 2019 "DK"
