The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.39 dated 4.4.2017 registered for the offences punishable under Section 22 of Narcotic Drugs & Psychotropic Substances Act at Police Station Sadar Phagwara, District Kapurthala.

On asking of the court, Mr. Ajay Pal Signh Gill, DAG, Punjab, who is present in the Court accepts notice and submits that intimation by Registry informing of fixation of the petition has already been received and record of the case is available with him.
As per case of prosecution, the petitioner was apprehended on 4.4.2017 and from his possession some drugs which included injections on which "Bupre Norphine and Phenira Mine Meleate" was mentioned, were recovered. CRM-M-24861 of 2017 -2As the FSL report has not been received by the police, the petition is allowed and the petitioner is granted interim bail till receipt of FSL report subject to his furnishing bail bonds and surety bonds to the satisfaction of concerned Chief Judicial Magistrate/Duty Magistrate. If on FSL report, the contraband is found to be of some narcotic and offence punishable under Narcotic Drugs & Psychotropic Substances Act is made out against him, he will surrender in the court. Disposed of accordingly.
