Present petition under Section 438 Cr.P.C. for grant of pre-arrest bail to the petitioner in case FIR No. 30 dated 15.6.2017, registered under Sections 420, 467, 468 & 34 IPC and Sections 67 & 63/1/14 of the Excise Act, 1914 at Police Station Quilla Panipat, District Panipat. Learned counsel for the petitioner contended that petitioner is not involved in the commission of offence in any way as he was arrayed as an accused which is legally not permissible.
Having considered the submissions made by learned counsel for the petitioner and the fact that undisputedly, petitioner is an owner of the premises, which was being used for the purpose and there is no material on the file to show that the same was let out to anybody.
