The petitioners seek the concession of anticipatory bail in FIR No.0045 dated 24.04.2017 under Sections 306/511 IPC registered at Police Station Mehtiana, District Hoshiarpur.

Learned counsel for the State, on instructions from ASI Rakesh Kumar, informs that the victim in this case has since passed away due to burn injuries. The FIR in question now stands registered under Section 306 IPC. Learned counsel for the petitioners has urged that petitioner No.1 is an old lady of 65 years and she suffered a spinal injury due to which she is bedridden. There are specific allegations against the petitioners. There is a specific statement of the victim on the basis of which the present FIR has been registered. The medical prescriptions (Annexure P5 and P6) do not in any manner indicate that petitioner No.1 is bed-ridden. The victim in question, a 14 year girl, has since died. In the facts and circumstances of the case, I do not find any ground to afford the concession of anticipatory bail to the petitioners. Petition is accordingly dismissed.
