Mr. AGS Dhillon, Advocate for the complainant. *** Petitioner and complainant are present in the Court. The parties have reached a settlement between them almost on the same terms and conditions as incorporated in the order dated 5.7.2018 except that the petitioner would pay a sum of Rs.18 lacs instead of Rs.17 lacs as agreed earlier. A demand draft in the sum of Rs.3 lacs has been handed over to the complainant by the petitioner. The parties have agreed to withdraw the cases filed by them against each other so as to facilitate the implementation of the terms arrived at between them. Learned counsel for the complainant states that he does not oppose the request for grant of pre arrest bail to the petitioner. CRM-M No. 25865 of 2018 petitioner is not required by the police for investigation at this stage. Under the circumstances, the present petition for pre arrest bail filed by the petitioner is accepted and it is directed that in event of his arrest in this case, he be released on bail subject to his furnishing surety bond to the satisfaction of the Investigating Officer/Arresting officer subject to his fulfilling conditions under Section 438(2) Cr.P.C. As regards the articles taken into possession by the police belonging to the complainant, she may move the Illaqa Magistrate for getting those released on Superdari.
