(ORAL) Prayer in this petition is for grant of anticipatory bail to the petitioners in cross-version bearing GD No.22 dated 27.05.2018 under Sections 452, 323, 427, 148, 149 IPC in FIR No.43 dated 25.05.2018 under Sections 452, 325, 324, 323, 148, 149 IPC, registered at Police Station Ghuman, District Batala.
While granting interim bail to the petitioners, following order was passed on 13.06.2018: - "Counsel for the petitioners submits that even from the side of the petitioners, the injuries were received and the FIR was registered against the complainant party. Counsel for the petitioners further submits that it is a case of version and cross-version and as per the version given in the FIR, the complainant party has entered the VISHNU 2018.09.11 15:39 I attest to the accuracy and authenticity of this document High Court, Chandigarh
CRM-M-25866-2018 -2house of the petitioners. Counsel further submits that there was a fight between the parties with regard to plot and it is yet to be seen which party was aggressor and which party was in self-defence. Notice of motion for 11.09.2018."
Learned counsel for the petitioners submits that in pursuance of the order dated 13.06.2018, petitioners have joined the investigation and are not required for any further investigation.
Learned State counsel, on instructions from ASI Gurmukh Singh, has not disputed the factual position and states that the petitioners are no more required for any further investigation.
In view of the above, this petition is allowed and the interim bail granted to the petitioners vide order dated 13.06.2018 passed by this Court is made absolute subject to the conditions envisaged under Section 438 (2) Cr.P.C.
