The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.112 dated 24.5.2016 registered for the offences under Sections 406, 420 and 34 IPC at Police Station Naraingarh, District Ambala.
I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that in the present case, the FIR has been registered on the basis of application sent by the complainant. The District Collector of Ambala found the allegations levelled by complainant Mehar Singh true in his order dated 22.3.2016 against Shamsher Singh Lambardar from the report dated 22.9.2015 of SDO (Civil), Naraingarh to the effect that he had stopped the old age pension of Amar Nath by declaring him dead and got it issued again for the same person by showing HARPAL SINGH PARMAR 2016.08.03 17:06 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-25800 of 2016 [2] him alive and both the forms were verified by Shamsher Singh Lambardar and Gram Sachiv Jagmal Singh by putting their signatures. There is also allegation that Amar Nath had embezzled the Government funds by wrongly withdrawing pension from the years 1999 to 2010. Keeping in view the nature and gravity of the offences and the allegations against the present petitioner, I find that the petitioner is required for custodial interrogation, therefore, I do not find it a fit case where the present petitioner is entitled to the benefit of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
