In the High Court of Punjab and Haryana, at Chandigarh Civil Revision No. 1371 of 2022 Date of Decision: 18.04.2022 Rajender and Others ... Petitioner(s)

Versus

Mandir Shri Durga Ji (IDOL) and Others ... Respondent(s) CORAM: Hon'ble Mr. Justice Anil Kshetarpal.

Present:

Mr. Arihant Jain, Advocate for the petitioner(s).

Anil Kshetarpal, J.

1.

The judgment debtors assail the correctness of the order dated 24.03.2022, passed by the Executing Court, while issuing the warrants of possession.

2.

The judgment and decree was passed on 23.05.2016, in favour of the decree holder, which is a religious institution. Certain defendants (judgment debtors) have filed an application under Order IX Rule 13 CPC for setting aside the ex parte decree, whereas certain others have filed an appeal, which is pending for the last 51⁄2 years. In the aforesaid proceedings, the judgment debtors have failed to get any interim protection. 3.

In view of the aforesaid facts, no ground is made out to interfere. Hence, the present revision petition is dismissed. (Anil Kshetarpal) Judge April 18, 2022 "DK"
