(ORAL) This is a petition for quashing of FIR No.87 dated 11.5.2012, under Sections 420 IPC, registered at Police Station, Sultanwind, District Amritsar, registered at the instance of respondent No.2 Satinder Singh alleging that the petitioner had entered into an agreement of sale with the complainant and received a sum of Rs.56 lacs but the property stood already sold to other persons.
As per the terms of compromise, the petitioner had agreed to execute another sale deed in favour of the complainant. Counsel for the complainant has appeared and stated that the terms of the compromise have not been complied with.
CRM-M-24988-2015 (O&M) On asking of the Court, State counsel informs that the petitioner has not yet been arrested, as such, challan also could not be presented.
Taking into consideration the above said circumstances, I am of the considered opinion that no valid compromise has been arrived at between the parties. The petition is dismissed with liberty to the prosecution agency to proceed in accordance with law. (M.M.S.BEDI) JUDGE October 1, 2015.
