******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 114 dated 10.07.2016 registered for the offence punishable under Section 22 of Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Mehatpur, District Jalandhar (Rural). Heard.

Learned State counsel on instructions from ASI Darshan Singh submits that the petitioner has put in appearance before the trial Court and after filing the challan, charge has been framed against him. The petitioner had not appeared during remand proceedings and vide order dated 09.02.2017, his bail was cancelled.

CRM-M-24967-2017 -2the trial Court and thereafter, challan has been presented by the police, this petition is allowed and the order dated 17.07.2017 is made absolute subject to the condition that petitioner shall appear before the trial Court on each and every date of hearing. In the event of his non-appearance on any date, the trial Court will be competent to cancel his bail and forfeit the bail bond and surety bond and take the petitioner into custody.
