On previous date of hearing , delay in trial was noticed and an explanation was sought from the trial Court. 3.
Report dated 20.10.2025 has been forwarded by learned trial Court explaining the reason of delay, which read as under:- i) Primarily there was sequential addition of multiple accused persons.
ii) The challan was filed against Anil and Yogesh, but later on supplementary challans were filed against Krishan, Rohit, and Raju on different dates.

iii) Finally charges were framed against total five accused persons on March 6, 2024.
iv) Court has been facing the difficulty in securing presence of prosecution witnesses as PW-1 Krishan and PW Kapil were summoned through bailable and then non-bailable warrants and then examined in May 2024.
v) On May 6, 2025, accused Krishan failed to appear, resultantly his bail was cancelled and NBW's were issued in November 2025.

Considering the reasons for an inordinate delay in the trial proceedings, coupled with the prima facie role assigned to the petitioner in the present case i.e. firing a shot directly upon the deceased, it appears that petitioner-Anil is the main accused in the case.
