As per allegations in the FIR,a gang of five persons apprehended were to meet the petitioner/accused for identifying and disclosing the name of the person who was to be murdered namely Neeraj Kumar.

Learned counsel for the petitioner contends that except the disclosure statement of the co-accused there is no material against the present petitioner on record and he is in custody since 30.4.2015. CRM-M 24933/2015 Learned State counsel on instructions from SI Balwant Singh concedes that challan has been presented and except the disclosure statement there is no other evidence on record. Without expressing anything on the merits of the case, keeping in view the fact that the challan has been presented and the trial is likely to take considerable time and further no useful purpose would be served by keeping the petitioner in custody, the present petition is allowed and petitioner is directed to be released on bail subject to the satisfaction of CJM/Duty Magistrate,Rupnagar. 17.08.2015.
