ANUPINDER SINGH GREWAL, J. (ORAL) The petitioner is seeking anticipatory bail in FIR No.1044 dated 10.11.2016 under Section 420 IPC registered at Police Station Karnal Sadar, District Karnal (Annexure P-1).

Learned counsel for the petitioner contends that the allegations against the petitioner are that he had got allotment of a second plot without disclosing that he had earlier allotted a plot by HUDA. He further contends that Coordinate Bench of this Court in the case of similarly situated person in CRM-M-8123 of 2017 titled as Lal Singh vs. State of Haryana had granted anticipatory bail to the petitioner therein vide order dated 19.05.2017.

This Court vide order dated 14.07.2017 had directed the petitioner to join investigation and in the event of his arrest, he was ordered to be released on ad-interim bail to the satisfaction of Arresting/Investigating Officer, subject to the conditions envisaged under Section 438(2) Cr.P.C.

CRM-M-25058-2017 -2Learned State counsel, on instructions from HC Sanjay, states that in pursuance to the order dated 14.07.2017, the petitioner has joined investigation and is not required for custodial interrogation. In view of the above and without expressing any opinion on the merits of case, the order dated 14.07.2017, granting ad-interim bail to the petitioner, is hereby made absolute. However, the petitioner shall abide by the conditions envisaged under Section 438(2) Cr.P.C. The petition stands disposed of accordingly.
