******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to petitioners in case FIR No.27 dated 19.01.2017 registered for offences punishable under Sections 406, 420, 467, 468, 471 read with Section 34 of Indian Penal Code (for short, "IPC") at Police Station Civil Lines Sonepat, District Sonepat. Heard.

Learned State counsel submits that after completion of investigation, police has presented the challan in Court. Learned counsel appearing for complainant-Mukesh Khatri submits that the matter has since been amicably settled between the parties and has placed on record affidavit of complainant-Mukesh Khatri to this effect.

Keeping in view the fact that the petitioner has amicably settled the matter with the complainant but without expressing any opinion on Jitender Kumar 2017.08.10 18:32 I attest to the accuracy and integrity of this document CHANDIGARH

CRM-M-25060 of 2017 -2merits of the case, the present petition is allowed. Petitioners, namely, Neeraj Sharma and Murari Parsad are ordered to be released on regular bail on furnishing bail bond and surety bond to the satisfaction of concerned trial Court/Chief Judicial Magistrate/Duty Magistrate, subject to following terms:- (a) The petitioners shall comply with the conditions mentioned in Section 437(3) Cr.P.C.

(b) In the event of their absence on any date of hearing, the benefit of bail allowed to the petitioners shall stand withdrawn. The trial Court shall be competent to cancel their bail bond and surety bond and proceed to procure their presence in accordance with law. In that eventuality the petitioners shall have to apply for bail afresh. (c) They shall not leave the country without the previous permission of the Court.
