(ORAL) Present writ petition has been filed under Article 226/227 of the Constitution of India by the petitioners seeking issuance of writ in the nature of mandamus directing the respondents to refund the amount of Rs.2,19,465/- deposited by the petitioner with the respondent-department. Learned Counsel representing the respondents submits that the case of the petitioner is under active consideration of respondent No.4 and the same shall be decided within a period of six weeks from the date of receipt of certified copy of the order.

In view of the above, the same is accepted. The present writ petition is disposed off with a direction to respondent No.4 to decide the claim of the petitioner within the time stipulated hereinabove and release the amount (if found refundable) within a period of two weeks thereafter along with interest at the rate of 6% per annum, calculated for the period from its deposit till actual realization. However, it is made clear that in case, the respondents No.4 is of the opinion that the claim of the petitioner sans merit the same shall be adjudicated only by passing a speaking order after giving an opportunity of personal hearing to the petitioner and the same shall also abide by the time line stipulated hereinabove.
