*** HARSIMRAN SINGH SETHI , J. (ORAL) Learned counsel for the petitioners argues that keeping in view the facts and circumstances of the present case, the post of the Assistant should be filled 100% by way of promotion in view of the recommendations which have been made by the Departmental Promotion Committee held on 05.12.2019 (Annexure P-7). Learned counsel for the petitioners submits that on 05.1.2021, a detailed legal notice cum demand notice has also been issued to the respondentUniversity vide Annexure P-14 on 01.02.2021 raising the said grievance but without deciding the said issue, the respondents are going ahead with direct recruitment on the post of Assistant which will cause prejudice to the petitioners in case, their claim is accepted by the University at a later stage.

Learned counsel for the petitioners prays that the respondent-University may kindly be directed to decide the legal notice cum demand notice by passing appropriate speaking order so that, the petitioners should know the status and the stand of GEETA RANI 2021.04.

CWP-8981-2021 --2-- the respondent-University as to whether, the post of Assistant is to be filled 100% by way of promotion or is to be filled by way of direct recruitment, for which the advertisement No.3/2019 dated 30.07.2019 (Annexure P-5) has already be issued.

Notice of motion.

Mr. Sharad Aggarwal, AAG, Haryana who has joined the proceedings through video conference, keeping in view the service of advance copy of petition accepts notice on behalf of respondent-State and raises no objection in deciding legal notice dated 01.02.2021 (Annexure P-14) served by the petitioners in a time bound manner by passing an appropriate speaking order.

Keeping in view the request, the petitioners are only seeking a direction to respondent-University to dispose of their legal notice cum demand notice (Annexure P-14) dated 01.02.2021, without going into the merits of the case and expressing any opinion upon the merits of the case or the claim being raised by the petitioners in their legal notice cum demand notice dated 01.02.02021 (Annexure P-14), the present petition is disposed of with a direction to respondent No.2-Indira Gandhi University, Meerpur, District Rewari, Haryana to decide the said legal notice cum demand notice dated 01.02.2021 (Annexure-14) served by the petitioners by passing a speaking order within a period of two months from the date of receipt of a copy of this order. Present writ petition stands disposed of.
