State of Haryana Respondent

Present:

Mr. Abhinash Jain, AAG, Haryana M.M.S.BEDI,J.

The petitioner seeks the concession of regular bail in a case registered at the instance of Sultan Singh alleging that the petitioner had caused a stab injury with a knife on the left of abdomen. The first petition filed by the petitioner was dismissed on 20.11.2014. It has been informed, on the instructions of HC Manoj Kumar, that the complainant has already been examined. The medical evidence in the shape of statement of Dr. Munish has also been produced before this court for perusal. While disposing of earlier petition for bail, it was ordered that in case the trial is not concluded within a period of six months, it will be open to the petitioner to approach this court again.

In view of the fact that the complainant-injured having been examined after having been discharged from the hospital; petitioner being in custody since January, 2014; six more prosecution witnesses remaining to be examined, the petitioner can be granted the concession of bail. The petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court, subject to the condition that the petitioner will not commit, the similar offence, of which he is accused of, during pendency of the trial and will not tamper with evidence, in any manner.
