ARVIND SINGH SANGWAN, J. (Oral) The petitioner prays for grant of anticipatory bail in FIR No.0234 dated 24.12.2016, registered under Sections 420 and 406 IPC at Police Station City Rupnagar, District Rupnagar. The operative part of the order dated 15.06.2018, vide which interim anticipatory bail has been granted to the petitioner, is reproduced as under:- "....Counsel for the petitioner submits that the petitioner is not working as a travel agent and he is known to two travel agents, namely, Ashish Kakkar and Sandeep Singh and on account of some dispute the petitioner filed a private complaint against 05 persons including the complainant Pritam Chand and Ashish Kakkar prior to the registration of FIR, under Sections 420, 467, 468, 471, 506 and 120-B IPC and the same is pending before the Sub Divisional Judicial Magistrate, Sultanpur Lodhi. CRM-M No.26070 of 2018 Counsel for the petitioner further submits that the present FIR has been registered with the allegations pertaining to the year 2016 and the FIR is registered in the year 2018 just a counter blast to the complaint filed by the petitioner.

Notice of motion for 25.09.2018...."

Counsel for the petitioner has submitted that the petitioner is ready to deposit an amount of Rs.2,00,000/- in favour of the complainant, with the trial Court/Illaqa Magistrate, subject to final outcome of the case.

Counsel for the complainant has no serious objection to the same.

In view of the above, this petition is allowed and the interim bail granted to the petitioner vide order dated 15.06.2018 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C., subject to the condition that the petitioner will deposit an amount of Rs.2,00,000/- on or before 11.03.2019 before the trial Court/Illaqa Magistrate and the complainant will have a right to withdraw the same, subject to final outcome of the case. It is made clear that in case the petitioner fail to deposit the aforesaid amount, the present petition shall be deemed to be dismissed without any further order.
