(ORAL) The appellant Jaspal Kaur has filed this appeal challenging judgment dated 02.08.2001 whereby her petition for grant of a decree of divorce, has been dismissed. Counsel for the respondent states, on instructions, that as the respondent husband has passed away, the appeal has been rendered infructuous.

Counsel for the appellant pleads no instructions. We have heard counsel for the parties and as we find no reason to doubt the correctness of statement made by counsel for the respondent, dismiss the appeal as infructuous but with liberty to seek revival in case there is any error in the statement made by counsel for the respondent.
