Due to the outbreak of pandemic COVID-19, the instant case is being taken up for hearing through video conferencing. This is the second petition filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No. 43, dated 16.02.2020, under Section 379-B IPC (offences under Sections 379-B(2), 341, 411, 34 IPC added later on), registered at Police Station Maqboolpura, District Amritsar. Learned counsel for the petitioner inter alia contends that the petitioner is in custody since 17th February, 2020, and charges have not been framed till date. The FIR in question was registered against unknown persons, wherein, it had been stated that while the complainant was riding his scooter, three youths came from behind and after threatening him with 'datar' snatched his mobile phone and fled away from the spot.

He further contends that the alleged recovery of 'datar' used during the crime in question and the mobile phone, which was allegedly snatched, were shown to have been recovered from the petitioner. Learned counsel for the JAWALA RAM 2020.07.

On the other hand, learned State counsel on instructions from SI Himanshu, has apprised this Court that the charges have not been framed so far and are likely to be framed on the next date of hearing. The delay has occurred on account of the outbreak of pandemic COVID-19. The State counsel has confirmed that the petitioner is not involved in any other criminal case.

Heard.

In view of the submissions made by learned counsel for the parties and keeping in view the fact that the petitioner is in custody since 17th February, 2020, no useful purpose would be served in keeping the petitioner behind bars, as the trial is unlikely to conclude in the near future, more so in the prevailing conditions due to the outbreak of pandemic COVID-19. Accordingly, I deem it a fit case for grant of the concession of regular bail.
